FAQ
Why protect your trademark from the start of a project?
Because a trademark that is available today may not be available tomorrow. Checking availability and protecting your name from the outset can save you from having to rebrand after investing in your branding, packaging or website.
Contrary to popular belief, simply using a name does not give you exclusive rights to it.
The same applies to other intellectual property rights. With designs and patents, disclosing a creation or an invention before filing may, in some cases, permanently prevent it from being protected.
When should you call on an IP lawyer?
As early as possible. Taking action early is almost always more effective, and less costly, than dealing with a dispute or problem once it has arisen. Intellectual property is too important to leave to chance. Working with a lawyer who specializes in this area helps you make the right decisions from the outset and avoid costly mistakes later on.
What should you do in case of counterfeiting or copying?
Acting quickly is essential, whether you are bringing a claim or defending one. We assess the situation, gather the necessary evidence and work with you to determine the most effective strategy. Depending on the circumstances, we may arrange for evidence to be preserved, seek an amicable resolution or bring proceedings before the courts.
What's the difference between copyright, trademarks and designs?
These rights protect different aspects of your business. Copyright automatically protects original works (such as written content, images, software and other creative works) from the moment they are created, with no registration required.
A trademark protects a distinctive sign, such as a name, logo or slogan, used to identify your products or services. In most countries, registration is required to obtain exclusive rights.
Design rights protect the appearance of a product or user interface, including its shape, lines, colours and overall visual appearance.
These rights are often complementary and, depending on your business, can be used together to provide broader protection.
Do you only work with clients in Bordeaux and Rennes?
No. While many of our clients are entrepreneurs based in Brittany and the Bordeaux region, we work with businesses throughout France, as well as foreign companies with interests in the French or European markets.
We regularly advise clients in the wine, spirits and broader food and beverage sectors, working with companies based across France and abroad.
Most of our work is carried out remotely, by phone, videoconference or email, allowing us to work with clients wherever they are.
